Abstract

Conciliation in the new Mexican labor justice system represents the fundamental basis for individuals involved in labor disputes to resolve their differences through negotiation and dialogue. Labor conflicts arising from human interactions in the workplace, in accordance with evolving labor relations that encompass not only job stability but also new forms related to information and communication technologies and digital platforms in the workplace, undoubtedly demand dialogical methods for their resolution.

The conciliation method in labor justice represents the progressive realization of the right of access to justice. It is articulated with the guiding principles of the constitutional and legal approach for the agencies and courts, as well as for the professional conciliators who act as a proactive bridge for effective communication between the parties involved in the dispute, both in pre-trial proceedings and in court-ordered conflicts. The study adopts an empirical-descriptive approach that integrates an analysis of the regulatory framework, a reconstruction of the procedure in Conciliation Centers and labor courts, and a review of official statistics regarding settlement rates, process duration, and levels of litigation. It concludes that, while conciliation operates as an efficient mechanism within the system, its legitimacy as a means of accessing justice depends on the substantive implementation of its guiding principles in practice.
